Terms of Service

The rules that apply when using ChalkedUp as an athlete, volunteer, or competition host.

1. Acceptance of these Terms

These Terms of Service govern your use of ChalkedUp. By creating an account, registering for an event, hosting an event, or otherwise using the platform, you agree to these Terms. If you do not agree, do not use the service.

2. What ChalkedUp does

ChalkedUp is a competition management platform for athletes, volunteers, and event hosts. It can be used to publish competition information, manage registrations and divisions, schedule events, collect scores, display leaderboards, coordinate volunteers, send event communications, and facilitate event payments where enabled.

Unless expressly stated otherwise for a specific event, ChalkedUp is the technology platform and is not the organizer, sanctioning body, venue, coach, medical provider, or insurer for competitions listed on the service.

3. Accounts and account security

You are responsible for providing accurate account information, keeping your login credentials secure, and for activity that occurs through your account. You must not impersonate another person, create accounts for fraudulent purposes, or attempt to gain unauthorized access to another account or part of the platform.

Google Sign-In may be offered as an optional authentication method. While Google is connected, the matching ChalkedUp account email and password settings cannot be changed until Google is disconnected. Google Account credential changes are handled through Google. Linking a Google Account does not give ChalkedUp access to Gmail, Google Drive, Google Calendar, contacts, or other unrelated Google services.

4. Competition participation and risk

Fitness competitions and related activities can involve strenuous physical activity and risk of injury, illness, property damage, or other loss. You are responsible for determining whether you are able to participate safely and for following the rules, waivers, instructions, and safety requirements established by the event organizer or venue.

ChalkedUp does not provide medical advice and does not assess whether an athlete is fit to participate.

5. Responsibilities of hosts and users

  • Hosts are responsible for the accuracy of event details, eligibility rules, schedules, scoring methods, pricing, refunds, waivers, safety procedures, and communications they publish.
  • Athletes and volunteers are responsible for submitting accurate registration information and complying with event-specific rules.
  • Users must not upload unlawful, abusive, fraudulent, infringing, malicious, or misleading content.
  • Users must not interfere with the operation or security of the platform, scrape it in a manner that harms the service, or attempt to bypass access controls.

6. Fees, payments, refunds, and Stripe

Some competitions may charge registration fees or other event-related amounts. Payments may be processed by Stripe on behalf of the applicable event host. Stripe's own terms and privacy practices apply to payment processing.

Unless ChalkedUp is expressly identified as the event organizer, refund policies and disputes about an event charge are the responsibility of the event host. ChalkedUp may display transaction information needed to operate the platform, but it does not store complete payment-card numbers.

7. User and host content

You retain ownership of content you submit to the platform. You grant ChalkedUp a limited licence to host, reproduce, display, process, and transmit that content as reasonably necessary to operate, secure, improve, and support the service and the competitions for which the content was provided.

You are responsible for ensuring that you have the right to submit any content you provide, including names, images, logos, event descriptions, and other materials.

8. Third-party services and links

The platform may use or link to third-party services such as Google, Stripe, mapping services, email-delivery providers, and event or venue websites. Those services operate under their own terms and privacy policies. ChalkedUp is not responsible for third-party services that it does not control.

9. Availability and changes to the service

We work to keep ChalkedUp available and reliable, but the service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, error-free operation, preservation of every item of data, or that every feature will remain available indefinitely. We may add, change, suspend, or discontinue features when reasonably necessary.

10. Suspension and termination

We may suspend or terminate access when reasonably necessary to protect users or the platform, comply with law, investigate fraud or abuse, enforce these Terms, or address security concerns. Users may delete their own account through the account settings, subject to any platform restrictions needed to resolve competition ownership first.

11. Account deletion and retained records

When you delete your ChalkedUp account, personal account details are anonymized or removed from the active account where reasonably possible, including any linked Google identifier. Certain competition, registration, transaction, audit, or other records may remain when needed for legitimate operational, legal, security, accounting, or record-keeping purposes.

12. Limitation of liability

To the maximum extent permitted by applicable law, ChalkedUp and those involved in operating the platform will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, participation in an event, reliance on event information, third-party services, or loss of data.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded or limited.

13. Privacy

Our Privacy Policy explains how ChalkedUp collects, uses, stores, and shares personal information, including information used for Google Sign-In.

14. Changes to these Terms

We may update these Terms from time to time. The current version will be posted at this URL with the date of the latest update. Continued use of the service after an update takes effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of New Brunswick and the federal laws of Canada applicable in New Brunswick, without regard to conflict-of-law principles. Any rights you have under mandatory consumer or privacy laws continue to apply.
